    GSA 1122 Program Expansion for State and Local Governments

    Section 885 of the Duncan Hunter National Defense Authorization Act for Fiscal Year 2009 amended 10 U.S.C. 381 to expand the procurement authority under the 1122 Program beyond counter-drug activities -- now include equipment for homeland security and emergency response activities. The statute further specifies that any equipment to be used for homeland security activities must be included on the Authorized Equipment List published by the Department of Homeland Security (DHS).

    The 1122 program is based on a 1994 National Defense Authorization Act. It established the authority for states and units of local government to purchase law enforcement equipment through federal procurement channels, provided that the equipment is used in the performance of counter-drug activities. The 1122 Program affords state and local governments the opportunity to maximize their use of taxpayer dollars, by taking advantage of the purchasing power of the federal government, to receive discounts commensurate with large volume purchases.

    The governor of each state participating in the 1122 Program designates a State Point of Contact (SPOC) to administer the state's activities under the program by validating the counter-drug mission of each procurement request and ensuring the availability of funds.

    With the approval of the executive agent, GSA has authorized states and units of local government to purchase certain products under selected GSA Schedules and Special Item Numbers (SINs) in support of their counter-drug missions. GSA publishes the Law Enforcement Equipment and Supplies Catalog (1122 Catalog), which explains how the 1122 Program works and identifies the equipment and supplies available from the Army, GSA, and DLA. All GSA items authorized for use under the 1122 Program, as well as detailed information regarding ordering procedures, are contained in the 1122 Catalog.

    As a result of the new legislation, a pilot program has been created to implement expansion of the program. The following six states have agreed to participate in the pilot program:

    • Arizona

    • California

    • Florida

    • Georgia

    • Nevada

    • North Carolina

    In addition to the 1122 Program, state and local government entities may take advantage of the purchasing power of the federal government through the Cooperative Purchasing Program, the Disaster Recovery Purchasing Program and the Public Health Emergencies Grant programs.
